Orange shooter arraigned in Franklin Superior Court today; ordered held on $20,000 bail

At today’s arraignment in Franklin Superior Court, Judge John Agostini ordered Robert "Bobby" Donovan, 25, of Orange held on $20,000 cash in connection with the shooting on Nov. 24, 2011 of Brian "Cali" Baker inside Donovan's 18 Mechanic Street, Orange apartment. Donovan is to have no contact with the victim or witnesses in the case.

A pretrial hearing has been scheduled for March 8 in Franklin Superior Court at 2 p.m.

Based upon an investigation by the Orange Police Department and Massachusetts State Police, the Franklin County grand jury returned indictments for 1) aggravated assault and battery by means of a dangerous weapon causing serious bodily injury, 2) unlawful possession of a firearm without an FID card, 3) misleading police during a criminal investigation, and 4) perjury. 

“These indictments are the product of the relentless work of the Massachusetts State Police Detectives Unit assigned to the Northwestern District Attorney’s Office and the Orange Police Department,” said Assistant Northwestern District Attorney Jeremy Bucci, the prosecutor on the case.

Donovan is alleged to have lied to police and to the grand jury about the shooting, claiming that Baker had already been shot when he arrived at the apartment.

According to police, Donovan had obtained the.22 caliber revolver used in the shooting during the summer of 2011 and was keeping the firearm hidden inside his apartment. Police say he was responsible for loading the weapon and after bringing it out to show Baker on Nov. 24 at approximately 5 a.m. pointed it in Baker's direction and pulled the trigger twice, causing the gun to discharge the second time.

As a review of the Donovan’s Board of Probation record, indicates that he was previously convicted of the crime of assault and battery on a police officer, the grand jury also returned an armed career criminal enhancement on the unlawful possession of a firearm indictment.
